The Zona Azul prices are set by the municipality — the city hall, the city council and, where applicable, the concessionaire that operates the service. The rotational-parking rate is municipal and varies from city to city. What is NOT set by the municipality is the traffic fine, which is federal and fixed. The rate is municipal
The Constitution and the Brazilian Traffic Code give the municipality authority over local traffic management, which includes rotational parking. In practice, this means the city hall, backed by the city council through a law or decree, defines:
- The rate per period;
- The charging hours and the days of the week;
- The maximum parking time;
- The exemptions (seniors, people with disabilities, motorcycles, residents, etc.);
- The existence and the rules of the post-use fee.
When the service is granted to a company, the concessionaire operates the charging, but within the parameters and caps set in the contract and in municipal legislation — it does not set prices freely.
How the rate is usually set
- The city hall or council establishes, by law or decree, the legal basis and the limits of the rate.
- The amounts per period are set (e.g., per hour or fraction).

The fine is federal and fixed
Here's the most common mistake: thinking the city hall "decides the fine." It does not. The penalty for parking in violation of the regulation is set in CTB Art. 181, XVII; it is a serious offense, worth R$ 195.23 and adds 5 points to your license — the same in any city in the country. The municipality issues the citation, but it does not change that amount.
