What's the difference between Zona Azul and private parking?

Understand the differences between Zona Azul (public street) and private parking: legislation, responsibilities, and rights.

The essential difference is the place and the rule that applies: Zona Azul is the paid use of a space on the public street, governed by the Traffic Code and municipal law, while private parking is a commercial service on private property, governed by a contract and the Consumer Protection Code. In one you're on the street, under traffic enforcement; in the other, inside a property, under a company's responsibility. This changes who enforces, what happens if you don't pay, and who is at fault for damage to the car.

Where you are: public street vs. private property

In Zona Azul, the car occupies a marked space on the street, a public asset. The municipality regulates its use to ensure turnover. In private parking, the car sits on a privately owned lot or building, and using the space is a commercial relationship between you and the company.

Who enforces and what the penalty is for not paying

This is the point that confuses people most:

  • Zona Azul: enforcement is by the traffic officer or the company authorized by the municipality. Not activating or exceeding the time constitutes the infraction under CTB Art. 181, XVII — serious, R$ 195.23, 5 license points, and vehicle removal.
  • Private parking: there's no traffic fine. What exists is a contractual charge (the daily or hourly rate). If you don't pay, it's a matter of civil debt collection, not points on your license.

Liability for theft and damage

Another important practical difference:

  • In private parking, the company has a duty of safekeeping. If the car is stolen or damaged inside, it is generally liable, under the Consumer Protection Code and settled case law.
  • In Zona Azul, you only pay for the right to use the street space for a time. The municipality does not assume custody of the vehicle, just as it wouldn't on any other street.

Why this distinction matters day to day

Confusing the two leads to costly mistakes. Thinking Zona Azul "guards" your car causes frustration; thinking private parking "issues traffic fines" does too.
